So that is just your agreement with your spouse, which is lawful. You would also though have to fill out the petition for divorce. Your documents would have to be filed with the family court in your county. (TX Fam Code § 102.008)

You will fill it out, and take it to the court so that it's filed with the court. Meaning the court then has a record of it. (TX Fam Code § 6.301)
