Solved

If your mother gave you the coins as a gift with no written agreement or conditions, they are legally presumed to be yours, even after estrangement. A gift, once completed, cannot usually be revoked just because the relationship changed.

Her threat to involve police or a lawyer doesn't automatically mean you must return the coins unless she can prove it wasn’t truly a gift. Without documentation or clear evidence that the coins were only loaned or held for safekeeping, her legal options are limited. (Fed. R. Evid. 301)

Do I have to return a high value gift after parental estrangement?

I understand that dealing with parental estrangement can be very challenging. Can you tell me more about the circumstances surrounding the gift and your relationship with your parents?

December of 2024, my mother gave me silver and gold bouillon coins that she said were divided equally for my sister and I. August of 2025, I went no contact with my mother after determining that she has been lying and manipulating familial and financial relationships. At first, I just wanted to pull back from helping with her finances because my sister has been purchasing large ticket items out of my mother’s account but she doesn’t confront my sister on it.

Long story short, my mom enables my 51 year old sister and I don’t want to be in a financial relationship with them. My mom interpreted this as me pulling away from my relationship with her. I kept trying to reassure her that I will call and visit her but I don’t want financial responsibility in this toxic situation. My mom became increasingly vile and toxic to the point that I did pull away and I haven’t spoken to her since August 4, 2025.

Have you already discussed the gift with your parents or any family members since the estrangement occurred?

Now she wants the coins back and has threatened to file a police report and get a lawyer. What recourse do I have? Can she do this legally?

Is there anything else the lawyer should know before I connect you? Rest assured they'll be able to help with your gift dispute.

Yes.

Hello! Legal Eagle here, and I am an attorney specializing in your area of law. I am more than happy to help you with your situation!

Have you documented or saved anything that shows your mother clearly gave you the coins as a gift rather than just loaning or holding them for safekeeping?

I can't think of anything right now.

No. There is no documentation.

She stated she was giving me my share. This was in December. Since our estrangement, she wants it back. It is high value, easily $60,000 worth of silver and gold. My dad passed away two years ago. There wasn't a will.
