[CA] How can a prenup protect inherited assets before marriage?

Thank you for your patience. What makes a prenup enforceable in California:

  1. It must be in writing and signed by both of you. It becomes effective when you marry. (CA Fam Code § 1611)
  2. The seven-day rule: each party must have at least seven calendar days between being presented with the final agreement, and being advised to seek independent counsel, and signing. Spousal support clauses are special. Any spousal support waiver or limits can be unenforceable if the party against whom it is enforced did not have independent counsel when signing, and it can also be struck if unconscionable at enforcement. (CA Fam Code § 1612)
  3. Full financial disclosure, or a very careful written waiver, is key to enforceability.
  4. Notarization is not strictly required, but many couples still notarize for proof later.

To reduce pressure or duress arguments later, aim for: By April or May 2026, both parties gather disclosures, assets, debts, income. By June 2026, first full draft exchanged, both retain separate lawyers if possible. By August 2026, final terms locked. At least seven-plus days before signing, deliver final version and sign only after the waiting period. You can sign close to the wedding legally, but it is a common litigation risk. (CA Fam Code § 1615)

Even though inheritances are generally separate property, disputes often arise if marital earnings pay for mortgage principal, remodels, taxes or insurance, or title changes or commingling, which can create community claims, for example Moore or Marsden type arguments. A prenup can explicitly say no community interest arises and define whether there is reimbursement, and if so, how.

What state or country will you and your fiancé be living in or getting married in, as prenup laws can vary by location? Besides the inherited homes, are there any other assets, debts, or financial concerns you'd like the prenup to address?

Marriage will take place in San Francisco, CA, where we live. I'd like the prenup to address inherited assets on both sides: hers: 2 houses, 2 parents' retirement, 1 uncle's retirement. Mine: none currently because thankfully my parents are still with us but there will be 1 home, 2 other properties, whatever retirement or cash is left. I personally only have a brokerage/Roth IRA account with around $30k total. The asset balance is hugely weighted toward her right now.

1 home is valued around $1.5m and the other $500–600k probably. Her parents and uncle all passed 9 years ago and left her everything.
