Is signing a prenuptial agreement just days before your wedding still legally valid?

Solved

Getting married soon gives you very little time, and while that is tight, it is not impossible. Case law shows that presenting an agreement close to the wedding date does not, by itself, constitute duress, so timing alone will not invalidate it. The agreement must be in writing, signed by both parties, based on full financial disclosure, and entered into voluntarily.

Your property, your business, and your children from a prior relationship are exactly the kind of interests a prenup is designed to protect. Courts will generally enforce a prenup in a future divorce as long as it is fair and negotiated properly, and each party should have independent legal representation. Contact a family law attorney as soon as possible and ask whether they can prepare an expedited prenup before your wedding, keeping in mind your partner will also need their own counsel to review it.

It's understandable to feel concerned about getting a prenup so close to your wedding date. Have you already discussed the idea of a prenup with your partner?

Yes, and it became heated and intense.

What specific terms or concerns do you want to address in the prenup?

I own property and have a business, and I have kids from a prior relationship.

Hello, I’m Legal Eagle. I’m an attorney who works in your area of law and I’ll help you sort this out today. I’ve read what you shared, so let’s go over what’s happening and what your best next steps look like. What state will you be getting married in, and are the properties and the business titled solely in your name right now?

We live in the same state, and the assets are in my name.

Thanks for sharing that. Could you let me know where your business is located? This will help in understanding which jurisdiction's laws might apply to it.

The business is located outside the U.S.
