What disclosure and legal requirements must a prenuptial or postnuptial agreement meet to be valid and enforceable?

Solved

Let's start with the prenup and postnup agreements. Each state has its own laws regarding these agreements, so it's important to know the requirements in your state. You do need free and open disclosure of the assets that would be excluded. Both parties should also have an attorney who can help them review and make sure the agreement is fair. A postnuptial is similar, just after marriage. For the name change, you both would have to file a petition for name change with the court.

Prenuptial (Premarital) Agreement

Full Conversation

I'm looking to potentially get a prenup, as I'm marrying my wife relatively soon. It would be mostly to protect both of our inheritances and my future potential for a pension, as I'm going into the army. We'd also, in the event of divorce, like to keep whatever we bring into the marriage separate monetarily. Additionally, we'd consider the possibility of a postnuptial agreement. Finally, we'd like to change our last name to something completely different after marriage, and we are not sure what that process looks like. Thank you!

It's great that you're being proactive about protecting both your and your wife's interests. Have you and your fiancée discussed the specific terms you'd like to include in the prenup?

Protecting the monetary assets we bring into the marriage, our inheritances, and my possible pension.

Are there any particular concerns or issues regarding your inheritances or pension that you want to ensure are addressed in the agreement?

I don't know.

Is there anything else the Family Lawyer should know before I connect you? Rest assured they'll be able to help with your prenup.

No.
