[CA] Can a judge reject a signed Marital Settlement Agreement?

If Marital Settlement Agreement would be not 50/50, but 60/40, could it be rejected by a judge? After 9 years of marriage, where I earned and paid 80–90% of everything, we want to stay with our own accounts (I’ll have about 5 times more money in my accounts) and split property evenly. Can a judge reject the Marital Settlement Agreement if we both sign it?

Hello! If Marital Settlement Agreement would be not 50/50, but 60/40, could it be rejected by a judge?

I understand you're concerned about the division of assets in your Marital Settlement Agreement. Can you tell me more about the specific terms of the agreement?

After 9 years of marriage, where I earned and paid 80–90% of everything, we want to stay with our own accounts (I’ll have about 5 times more money in my accounts) and split property evenly.

Have there been any significant changes in circumstances since the agreement was initially agreed upon?

No.

Is there anything else the lawyer should know before I connect you? Rest assured they’ll be able to help with your property division.

No.

California. Can a judge reject the Marital Settlement Agreement if we both sign it?

Hammad S. Esq.

A judge cannot. Marital Settlement Agreements are binding and non-revocable. Once they are signed and approved by the parties, they are binding on the court as well. The judge has to sign off on it.

Thank you.
