You may take several steps to reduce or eliminate the $2,000 LADWP bill for the period after you vacated your unit on November 2, 2024.

Contact LADWP Customer Service and file a billing dispute (CA Pub Util Code § 779.1(1)(e)). Explain that:

  • You moved out on November 2, 2024.
  • You believed all accounts were closed.
  • The unit has been vacant since you moved out.
  • You have not received any notices regarding an overdue balance.
  • You opened a new utility account in Irvine, which indicates you were residing elsewhere.

Ask LADWP to:

  • Retroactively close the account as of November 2, 2024.
  • Apply a vacancy adjustment or non-occupancy credit.
  • Provide copies of all notices they claim to have sent.
  • Provide monthly or daily usage data for the period after your move-out.

LADWP phone: 1-800-342-5397. You should also file the billing dispute online.

Get written proof from the apartment complex that the unit was vacant. Ask the property manager for a letter or email confirming:

  • Your move-out date was November 2, 2024.
  • No one lived in the apartment afterward and it remained vacant.
  • Utilities are not included in rent and tenants are responsible for their own LADWP accounts.
  • You did not occupy the unit again after November 2, 2024.

Review utility usage data. Request a usage history from LADWP. (CA Pub Util Code § 451)

  • If the apartment was vacant, usage should be extremely low.
  • Low consumption helps prove you should not be responsible for charges.
  • If usage is high, it may indicate a meter or billing error.

Escalate the dispute if LADWP doesn’t adjust the bill:

  • LADWP’s Consumer Affairs Division (internal appeals)
  • Los Angeles Department of Consumer and Business Affairs (DCBA) — Phone: 800-593-8222
  • CPUC mediation (although LADWP is municipal, they sometimes help informally)

Legal principle in your favor: In California, a tenant is responsible for utilities only until the date they vacate and surrender the unit. If you can show the move-out date and vacancy, LADWP can retroactively close the account.

While the dispute is pending: If needed, you can ask LADWP for a payment plan to pause collection activity, but this does not mean admitting fault.

I moved into an apartment from May 22, 2024, and moved out November 2, 2024. When I moved out, I was under the impression that I closed out all my accounts with the apartment complex.

I moved to Irvine to another apartment and set up a SoCal Edison account. I was a resident there from November 2, 2024 to October 31, 2025.

I am now moving back to the apartment complex in a different unit, and when setting up an account, I found out that I never reached out to LADWP to turn off service on November 2, 2024. I now have a current balance of $2,000.

The apartment complex states that a new tenant never moved into the prior unit after I moved out and the apartment is still vacant. I understand that it’s my responsibility to call and shut off service, but no one has lived in the unit to this day, and I have no communication stating that I have an overdue balance.

I understand how frustrating it must be to deal with this unexpected balance. Can you tell me if you have any written communication from LADWP regarding the account or the balance?

I have no written communication from LADWP regarding the account or the balance.

Have you attempted to resolve this issue with LADWP or the apartment complex since discovering the balance?

Yes, I have tried to resolve this issue with LADWP. I sent them all documentation and have provided my lease, a written statement from my apartment complex, and my new utilities at my new apartment. However, they have responded that because I never reached out to them to shut off service, the balance of $2,000 still remains.

Is there anything else the landlord-tenant lawyer should know before I connect you? Rest assured they’ll be able to help with your utility balance.

Yes.

Hello, I'm Legal Eagle. I understand you're dealing with an unexpected balance with LADWP after moving out of your prior apartment unit. I'm here to help you navigate this situation and explore your options. Could you share more about any recent developments or actions you've taken?

Have you had any recent communication with LADWP that might help clarify the situation?

The last action I’ve taken was sending LADWP written documentation of:

  • My new lease (November 2, 2024 – October 31, 2025)
  • SoCal Edison account (first and last billing statement)
  • A statement from my apartment complex confirming when I resided in the prior unit

They have responded that because they never received communication from me to shut off service, the balance still remains.

Thanks for sharing that. It sounds like you've already taken solid steps. Have you had any further communication with LADWP since they responded about the balance? Also, are there any other parties involved in this issue besides LADWP and your apartment complex?

I have not responded to LADWP since receiving the letter stating that after reviewing the situation, the balance still remains. I can provide that letter if needed. No other parties are involved.

Let me know if you need clarification or have a follow-up question.

From your perspective, can I or should I take legal action? If so, how much would that cost me if I wanted to go that route?

You can always represent yourself without an attorney.

  1. Evaluate the Necessity of Legal Action: Before pursuing legal action, consider whether all other avenues have been exhausted. It's often best to first attempt all possible resolutions with LADWP.
  2. Consider Small Claims Court: If the amount in dispute is within the small claims court limit (which varies by state), this could be a more cost-effective option. In California, the limit is $10,000 for individuals. Filing fees are generally low, and you can represent yourself without an attorney, which reduces costs.
  3. Estimate Potential Costs: Legal fees can vary widely depending on the complexity of the case and the attorney's rates. For a straightforward case, costs might range from a few hundred to several thousand dollars. If the case becomes more complex or goes to trial, costs can increase significantly.
  4. Weigh the Pros and Cons: Consider the potential benefits of legal action against the costs and time involved. If the evidence strongly supports your position, legal action might be worthwhile. However, if the costs outweigh the potential benefits, it might be better to continue negotiating with LADWP or seek mediation.

Please let me know if you have further questions.

Are you able to provide me with an attorney that handles small claims court matters in Los Angeles?

I can only recommend calling the LA Bar Association for a consumer protection attorney or a landlord-tenant attorney.

Ok, no worries. Thank you for your help.
