I am trying to add my son's name to the title of my property in Colorado. I want the title to show joint tenancy. I'm not sure if I've completed the form correctly.

I understand you're looking to add your son's name to the title of your property in Colorado. Have you already filled out a specific form for this purpose?

Yes, I've completed the Colorado quitclaim deed.

Are you looking to establish joint tenancy with rights of survivorship between you and your son on the property title?

Yes.

Is there anything else the lawyer should know before I connect you?

No.

Thank you for choosing AskaLawyer! My name is Jessica, and I am a licensed attorney who will be assisting you with your question. I am reviewing your question and will be responding momentarily. Will you be applying for Medicaid coverage within the next five years? If yes, then you cannot add your son as a joint owner on the deed.

No, I hope not!

So you are gifting him 50% ownership. You will want to use a quitclaim deed and make sure on the grantee line that it states "joint with right of survivorship" (C.R.S. § 38-31-101(1)).

Where on the form am I to indicate "joint with right of survivorship"?

Jessica B

On the line where you list both of your names as the grantees. I hope I was able to help resolve your issue! If you have any other questions, feel free to ask.
