[CA] Can a landlord waive liability for injuries pertaining to pool use?

Hello, I am creating a 12-month lease for prospective tenants. The property has a pool, and I want to create a bulletproof release of liability for any accidental death or medical issues pertaining to the pool. The tenant has children.

Okay, it sounds like you are looking for a waiver and release of liability for the pool. (CACI No. 1006. Landlord’s Duty)

While we can't provide legal documents to customers since we can't represent customers as clients, the eForms website should have a specific waiver and release of liability for a pool. This would basically say that you are not liable if the tenant, their family, or their guests or invitees are injured or die while using the pool.

For example, here is a pool and hot tub lease addendum that you could use as a template.

I understand the importance of ensuring safety for your tenants and their children. Have you already included specific pool safety rules in the lease agreement?

No.

Are you looking to include language in the lease agreement that clearly outlines the tenant's responsibility for supervising their children around the pool area?

No. As the property owner, I would like to recuse myself of any liability pertaining to the pool.
