The LLC provides protection and it's a good option. I would proceed but consider if possible having more than one member, as a multi member LLC tends to hold up better. The LLC should not be a shell entity but operate and have account(s), address, agents, and activity.

Is there anything else the lawyer should know before I connect you? Rest assured they'll be able to help with your liability protection.

No.

Hello and welcome. My name is Daniel, and I've been a licensed lawyer for more than 21 years. I’m sorry you’re going through this, and I’ll do my best to help. Is it a single member or multi member LLC?

Hi Daniel! It's a single member LLC, but I am trying to sell my art and my writing, so I am not sure how best to handle it.

Dan

Dan

You formed it? What is your concern with the LLC?

I haven't formed the LLC yet because I'm not sure how best to handle it. The things I've considered were to start a separate LLC for each side of things or to do one that's my name and covers both.

Does that make sense so far? I want to make sure you fully understand your options.

Yes, that does make sense. I have an account that I would use and I've looked into a designated agent. I am going to sell my art and my books on a personal website and on Etsy to start, but I'm hoping to get into some galleries. I also have a publishing contract already, so I'll be adding titles as they go to print.

To be clear, I have a designated bank account for the business already.

It's a good plan and protects you personally via its use. I want to make sure everything is clear and that you feel comfortable with the information I’ve provided. Is there anything I can clarify for you or do you have any additional questions for me? If everything makes sense, you can simply reply “All clear.” Thank you!

Okay, so to make sure I understand, your advice is to make sure the LLC is active and not a shell company?

Dan

Dan

Yes and if you can have another partner/member.

Okay, thank you.

One LLC with multiple partners is best for my situation.

All clear.

Dan

Dan

Yes, indeed.
