My father passed in 2024 without a will. He was married, and I do have power of attorney of his wife. Their house is paid for, but his wife can’t stay by herself, so since my father passed she has been with her daughter. The past year his wife has decreased mentally and has been diagnosed with the onset of dementia. I live 3 hours from the house, but still have maintained it.

We do have a buyer for the house. I am the only living child, and my brother had only one child, a son who is 30 years old. We have a buyer for the house, and I wanted to know if I could do an affidavit of small succession so we can sell the house.

I do understand that my dad’s wife gets half, and me and my nephew each get half of the other half. The value of the house and truck is under the $125,000.00 value. I have been in constant contact with her daughter and keeping her updated on things. My dad’s wife’s portion will go to her to help take care of her since she was diagnosed with the onset of dementia. We are trying to get all this taken care of before we have to put her in a nursing home. I also have kept my nephew updated on everything as well.

I would say the house is about $80,000.00 and the truck is about $18,000.00 and maybe even less than that.

Good questions. To prove there’s no will, you’ll typically just need to search your father’s papers and home. If you can’t find one, that’s usually enough. You could also contact the clerk of court in Caddo Parish to see if anything was ever filed there, but most of the time a thorough search at home is sufficient for the affidavit.

For the property value, you don’t necessarily need a formal appraisal. A reasonable estimate based on comparable sales in the area, tax assessments, or what you think it would sell for usually works. Since you already have a buyer, you could use that sale price as your estimate. For the truck, you could use Kelley Blue Book or similar resources.
