My mom and I were co-owners of our home, both on the deed and the loan. She passed six months ago, and we did a TOD Deed to leave her half to my son. However, we never filed an Affidavit of Death of Joint Tenant, so the TOD seems to be void. I need to understand my next steps with the mortgage lender, how to add my son on title, creating a trust, etc. This is a lot, but I need to start somewhere. I am located in Orange County, California.

I went online to generate a Small Estate Affidavit, and I'm not sure what to do next. How do I submit it to the court? I am not local to California, so I am hoping to explore options of submitting things virtually or having a relative in California act on my behalf. Would that be allowed?

I have a subtenant who is living in my apartment. We discussed orally on January 1, 2026 that he would move out by April 1, 2026. We then texted him confirming. Currently, this is the only way I have this in writing. I would like to know the proper procedure so that we can enforce this. I have reason to believe that he will not move out, and he has not been responding to my messages to pay rent for March 2026.

I rented my home for 3 years. Their lease is up on April 30th. The lease states if they stay beyond April 30th they can go month-to-month. They would like to stay in the home until June 15th. I believe I am exempt as I plan to take the home off the rental market. Do I need to provide relocation funds or waive the last month’s rent?
