[TX] Do I have to list my ex-husband on a small estate affidavit for my deceased son’s 401(k)?

My son passed away on 11/23 of 2025. I am doing a Small Estate Affidavit for Collection of Property. He didn't leave beneficiaries on his 401K. The 401K company doesn't accept probates. Will I need to list myself? Can I do this on my own or do I have to include my ex who is his father? His 401K is $50K.

[TX] Can I pursue civil and criminal action against my ex for knowingly making false CPS abuse claims?

My ex-spouse knowingly created a false CPS case alleging I was abusing my children and included the same claims in a sworn affidavit in a petition to modify our custody arrangement. I believe I have grounds for a civil tort. Do I also have grounds to pursue this criminally?

[TX] Can a home seller cancel after buyer delays caused by seller issues and refuse repairs without notice of termination?

We are trying to close on a house here in Texas. We were supposed to close on Dec 1 but could not get the survey done because the property had land that was not included in the listing that was owned by the drainage district. We had to get cleared from the district to do the survey. They approved us to do the survey and ordered the survey that same day. Survey was approved on the 22nd and had to extend the close date again due to the holidays. Seller did not sign the extension and when we followed up on the 26th for some repairs they still haven’t done they responded that they were going to take a cash offer. They never gave us notice of termination and told us we were not going to get the house. The hold up was in the seller’s end. We had been cleared to close and nothing on our end was holding up the sale.

[TX] What qualifies someone as a disinterested witness for a small estate affidavit?

I am going to file a small estate affidavit. It says I need a disinterested witness. Do these people have to know me, or can somebody there witness? I don’t have anybody that knows me that will go with me other than my husband. My family and friends work and they live out of town.

[TX] How do I transfer real property back to a family limited partnership using a special warranty deed and promissory note?

Over 20 years ago I established a Family Limited Partnership with a limited partner and an LLC as the general partner in Texas. On 9-12-2021 I created a “Property Bill of Sale / Promissory Note” where the purchaser provided $236,000 via promissory note, and the seller sold and delivered the property. Payment method: The purchaser will pay the purchase price by promissory note. Property: Multiple property IDs listed. Governing law: State of Texas. In an effort to establish a homestead exemption, which failed since I was listed as a partial owner of another property that already had such an exemption. I now wish to transfer this property back to the partnership.
